Thanks damccoy, I have one of those printers and have promptly filed a claim. As near as I can figure out I may get an e-credit for online purchase at the HP store. It will be interesting to see what that would amount to.

Depending on the model involved it will be $2, $5, or $6 of e-currency per unit. Sure its not a lot of cash value, it has to be used at HP Shopping.com, and the attorneys are the ones really making the money. However, the fact that this focused HP activity is being stopped and we users are receiving a benefit, it's better than a sharp stick in the eye.

I looked over the settlement, and it says, "HP has vigorously denied and continues to vigorously deny all of the claims and contentions alleged in the Ciolino, Rich, and Blennis actions, denies any wrongdoing and denies any liability to Plaintiffs or any members of the putative classes." So this means they're saying the Plaintiffs are lying?

Several years ago I installed a color cartridge with an expiration date that was about two weeks in the future. By the time the date arrived I had used it very little. When I tried to print it wouldn't let me, and I got a message telling me I couldn't print because it was beyond the expiration date. I know it wasn't a dream, and I didn't make this up.

I'm not happy about receiving a few measly e-credits. I have and still use my printer. A new color cartridge would be nice, I threw away two and one black one. Even with e-credits, HP still profits from me if I use them towards the purchase of a new cartridge priced at $39.99 retail at their store. IMHO the Plaintiffs aren't benefiting and HP isn't being punished.

The attorneys will be getting millions of dollars, not millions of e-credits! I am generally in favor of class action suits for wrongdoing, but it doesn't really seem to help the consumer -- the most affected party -- when the individual payouts are too measly to even bother with, or are just credits to be used to buy more of the offender's products. I'm not convinced it will improve HP's future performance, and the settlement may even help their bottom line since the "penalties" simply drive more business to them.

I once received a $0.02 check for a class action settlement of some sort. I meant to frame the thing but never got around to it.

Class action suits are a unfortunately a necessary evil. When defined and certified they encompass all except those who chose to opt out, and those of us who remain have no responsibility. How else would you address a legal concern which spans the country?

You can opt out, hire your own counsel, and pursue any claim you wish.

Further, no one is accusing anyone of lying. The civil legal system is a confrontational one which in the end the trier of facts, be it judge or jury, having heard the case of each side makes a decision based solely on the evidence presented.

The original plaintiffs will reap the rewards followed by the attorneys who in general get 1/3 plus costs. Those of us in the defined class normally get token relief.

In this matter it appears it was settled before trial in which HP admitted no wrong doing, but on their own created a pool of relief to be distributed in a defined fashion. The plaintiffs in this case agreed to the offer and following the date of closer the entire matter will be submitted to the presiding judge for his review, certification and order of settlement.

Since I didn't know anything about this litigation so I didn't participate. I guess anything I recover is a plus.

I have personally been involved as a defined party in maybe a half a dozen class action law suits of which I had no knowledge until I was notified that I was in the effected class, and the matter had reached a settlement. Most were from products I had registered with the manufacturer and one was a credit card company. In the credit card case I received 12 cents as it had to do with the way the CC company used the exchange rate of the American versus Canadian dollar. I don't shop in Canada often.

I have one CA pending where I am to receive $25.00. I have another one pending where I will be receiving $175.00.

I did have a CA suit that I was knowingly a participant that settled. It provided me with what amounted to $3007.00 a year for life besides other residual financial benefits.

In all cases I could have opted out, and legally proceeded on my own.

My deskjet printer is among those listed. I have never received any sort of official notification, so other than the link provided in DA's original post, I have no knowledge of anything. I've never had a problem with the printer or the inks; in fact, I do very little printing, so this means absolutely nothing to me.

I did receive notice several years ago concerning the CC company and the exchange rate in Canada, since I had used a CC while vacationing there. But I never received anything, even though I followed the instructions in the letter I received. I don't even know where it is now.

Yes, the only winners are the lawyers.
