Really need help with grading isue and builder

OK when the builder and I looked over my lot we agreed he would do all site work. There needs to be a minimum of 30 feet of side entrance garage. The lot grades down away from garage on the side. It winds up at a line of trees that mark the property line. He had a plot plan report done by an engineer. It shows the need for a drain and cast in place concrete retaining wall. My builder agreed to it. now that the foundation has been poured he is saying neither is needed. I dont want my driveway eroding away. He sais the first engineer was wrong and we will be fine. the contract states that all normal site work is his responsibility. He saw the lot and had a surveyer look everything over before we sighned the contract. The contract even sais he will put the drain on property line!

Hesais the new engineer feels it is not needed. Should I request he have the new engineer put this in writing?

On the face of it, I don't buy what he's selling. You signed an agreement for a retaining wall and that's what you should get.

Have you spoken to the first engineer to get his opinion? If he agrees, that would be a different matter.

As an aside, I prefer unit retaining walls where the engineer approves. I frequently see them replacing poured concrete walls on highway projects.

how much of a credit are you going to get if you take the retaining wall out? if you agree to take the item out - get in writing what your credit will be.

To the original question - does anyone like builder grade oak cabinets - my answer is no. But that's mainly because the particle board parts of the drawers and carcass usually come apart at some point, like the drawer front that came off in someone's hand. The thread seems to have veered off into a question of whether even solid oak cabinets are liked, and or dated. I love my oak cabinets even though they need to be refinished. They are good quality, custom built though, and I think that makes a difference. I also like painted cabinets, and might even go that route next time. This thread kind of reminds me of something that happened in 1978. We bought our first house that year, and so did some good friends. Both our kitchens had painted cabinets. Mine were brown with yellow doors, which I hated, along with the fact that they were older. I stripped and refinished them and they looked so much better. They were a slab style solid wood though I can't remember what kind now. My friend's cabinets (and house) were newer, white, raised panel with arched top. I thought they were gorgeous, but she thought they were terribly dated since wood was really in then, so she started stripping hers too. That's when she found out that the doors were made of particle board, and stripping ruined two of them. All that to say that painted vs wood comes and goes as we've discussed here before. If you like your cabinets and they are in good shape, keep the wood finished. If not, paint them. Whichever you choose, it will come back if it's not in now, and it will be out if it's not now. And that's probably the same with arched tops, beadboard panels, aprons between cabinets, and so on.

I think if you're going to do built-ins for the bar cabinet, you really need to match your kitchen for a seamless look. Why not place a piece of furniture there, that you can take with you when you move? Maybe something like this modular piece from PB, in black? https://www.potterybarn.com/products/modular-bar-suite/?pkey=cbars-furniture&isx=0.0.1854 Or, a buffet that you can serve food on when you have company? I'd put in the effort to move the light over the dining table one or two feet to the right. Then maybe rotate your table 90 degrees?

I would replace the existing siding on the gable end above the garage door with a shingle style of siding. It would give it texture and break up the linear pattern. I like the idea of adding a window, even if it is a false front. And paint it a darker color than the garage door. Replace the top row of the garage door with a section that has windows (lights) in it. The pergola is a great idea as well. Thin out the tree in front. It will make it look bigger and allow it to grow better as well. Better landscaping is needed. You need more varied height. And COLOR. Replace the lights on the sides of the garage door with something makes a statement. Something big and bold. You have a lot of vertical height to the front of your home. You need more horizontal width to give it some base. Landscaping can help with that. Painting the lower portions of your columns, your garage door, etc. a darker color will help ground your house.

Nice, I especially like what you did in the kitchen. Too often the advice here is that people should save up to rip out a perfectly functioning kitchen with solid cabinets instead of making incremental improvements like changing the backsplash, repainting the cabinets and installing new reasonably priced countertops. I love the new laminate countertops. They make a huge difference in that kitchen. I am not a fan of the stacked stone backsplash, but as long as your parents love it that is all that counts!

Ok, let me ask a quick question. Did the site plans have to be submitted to a planning board, or building dept? If they were, chances are they were reviewed by the town engineer's office (it's what I used to do) and the wall and drainage were recommended. if that is the case, you will need to have those features there before the town sings off on you build.

Ok, are the drains needed? Absolutely!!

Lets look why...
Drain 1.( Corner of lot near proposed wall) You have a fairly steep hill coming down from the road, it will have a good deal of runoff, a good deal of that is directed at your driveway. Even if it doesn't erode away at the base of the embankment it is going to get concentrated and run down your backyard and eventually cut it's own drainage ditch, if it doesn't cross the property line, then it's cutting a ditch in your neighbors lot. I am sure they won't be pleased about that.
Drain 2. (Your front yard, across from Drain 1.) Runoff from your driveway will collect there, and it looks like your front yard is pretty flat. The elevation of the drain is 187.0? and there is a spot elevation of 188.0 on the driveway, and about 25' to the left of the house, where the driveway meets the house, there is another spot of 188.0 This is to show whoever is grading the lot, that the yard drain should be 1 foot lower, and naturally water will collect there (at the drain). Drain 1 is connected to Drain 2, and from Drain 2, it looks like it goes to what looks like another yard drain in an easement that is part of the subdivision. (was this drain already installed by the original owner of the subdivision?)

It looks like the Engineer who designed the plans did a pretty good job making sure you would not have water issues, although I do not see foundation drainage, is there any? It looks like you have enough pitch to have the foundations drain to this 3rd Yard Drain.

What is the dark line just to the right of the driveway supposed to represent? A wall, drain, swale? I didn't see a note arrow.

Should the contractor do this work?
You said the contract says the contractor will do all normal site work, and he was aware of the site plans. That pretty much sums it up. he doesn't want to do, probably because he now has to dig across all the fill he put in where the driveway goes, and he should have done it before he graded the driveway. His error, he eats it!

The "Other Engineer" I really doubt the contractor talked to another engineer. And if he did I really doubt the engineer will sign off on no drains, or wall.

Do you need the wall and guide rail?
if by chance you forget to set your parking brake on your car. Do you want it going off the edge of the driveway, or bumping into the guide rail?
