OSB board and batten

I have a two story house which is being sided with osb siding with battens covering the seams and nail lines. The two stories are separated by a faily large covered porch. The contractor failed to line up the sheeting on the second story so the seams in the siding don't line up with those below. He is suggesting that he caulk the seams and nail heads and then put up the battens in line with those below. To me this seems like a cheap fix for his mistake. Is this a standard practice?
