Comments (14)Thank you to all that has responded. I'm so glad that there is other organic believer out there, I wish there were more in my small town. I'm still waiting on the phone call back, I'm not sure what usually happens on complaints. I'm interested to know how it will be handled. The man who does the work is an older man who does it himself for a retirement job. One comment he yelled to me last month when I chode him out for spraying the herbicide on a breezy day was "...you just don't understand that I have to make a living too." Thinking back on that comment he made makes me sick, that money is that important to him that he doesn't care what he's doing or who he is hurting. His priorty is to get as many customers as he can and go and get it done as fast as he can while being as careless as he wants to be... While not noting property lines, wind(even a little breeze carries that stuff) and run off to the street, even people, children, and pets in the next yard, etc... I hope I'm not known as a trouble maker. I love my neighbors, but the man they hire needs to be serious and responsible about what he does. While I might have a few more weeds then some people, I 'm okay with it. My husband is a Master Gardener and it doesn't hurt his pride a bit- we just keep the mower blade a little raised and it really helps. My grass is greener already, and wait another month when their grass will get burnt by that stuff when the temprature raises, lol. I'll enjoy my green, natural grass a bit longer(weeds and all). Comments (5)Paint your house haze gray, put a bunch of large ship models in the front yard and tell your neighbor you've joined the Navy and have been assigned to a battle group. Have weekly cookouts on the front lawn and invite everyone from the local shelter. Put aluminum foil on your windows and tell your neighbor it's to keep the government spies from finding out about the chicken farm in your basement(this one is especially effective if you don't have a basement). Go out with a tape measure, pencil and pad and measure everything in sight, including your grass, circumference of your trees, distance from house to car, house to tire, house to steering wheel, top of the windshield, etc. Put foil "antennas" on all your tree banches to repel alien invasions. Go outside in the evenings with a couple cases of beer and one of those hats that holds two cans and has hoses that you can suck on to drink. Sing a lot of bar songs. Go up on the roof occasionally and pretend to be an airplane. Write "wash me" in the dust on your own car. Water your garden in an evening gown and tiara. Wear lots of makeup and rat your hair. Paint your hands and feet green. Erect a duck blind in your back yard and camp out there frequently, quacking often to attract prey. Your neighbors will either move away or you'll be so busy acting crazy you won't care anymore what he does. And that's the answer-don't worry about what your nieghbor does! Comments (7)If it had just been the cooking odor, I'd have said there wasn't much you could do. But actual smoke is another matter. There are health concerns for one thing. For another, if there's that much smoke that it is getting into apartments several units away from the one producing the smoke, then I have to wonder about the smoke alarms in that unit. The tenant must have disabled them in order to cook this way. I'd play a little dumb about which unit it is. Contact the management or landlord and tell them that smoke is getting into your unit, and how often--daily, 4-5 times a week. You are concerned about 2 things--how this is affecting your health is one. And the second is that you are worried that so much smoke is being produced and no smoke detector is going off. Make it clear that you think something is wrong with the smoke alarms and that you are worried that in case of a real fire, the alarms won't sound. That should bring management out in a hurry. Most leases have clauses about maintaining an operating smoke detector in the apartment, so this other tenant could well be in violation of the lease. Comments (10)Basically I hear that if there is No Fault of such flood, if it ever happened, and if there is no way they can prove negligence on our side, then we are not to pay, but I'm just not clear how does this work. The insurance company has to prove that we did this. We were recently informed that there has been depositions by everybody (property manager, maintenance person) but nobody has approached us for one. Aren't we supposed to get our side of the story under consideration? How do they know where did the water come from? I know gravity is a factor but, couldn't this be a case of a lady opening a hose in her apartment and looking for reason to get remodeling at somebody else's expense, right? She claims that she had been on vacation for 2 weeks. How can they take her word without confirming if we have any water stains, mold or mildew in our unit? Well, if there was a flood, I'm sure there would be at least traces of such problem in our walls and swollen plywood in our cabinets. Right now it's only us against All State Insurance, as we (and I hate to say this) stu/*&^y didn't have insurance. We live in Miami, Florida. Does anyone knows anything that give us some light on how to approach this? Yes, we are know looking for an attorney so we can respond to this but so far the fee for a good lawyer is $3500 +$300 per hour. We are going to suffer no matter what...
