Hello fellow Ohioian,

Noisy neighbors can create an uncomfortable living environ ment. The Ohio Landlord/Tenant law does not create a clear remedy for tenants when the noisy neighbor is another tenant.The landlord does have authority under ORC 5321.11 to give the tenant creating the disturbance a thirty (30) day notice to correct a tenant violation of a tenant obligation at ORC 5321.05. ORC 5321.05(A)(8) states:

"A tenant who is a party to a rental agreement shall: Conduct himself and require other persons on the premises with his con sent to conduct themselves in a manner that will not disturb his neighbors' peaceful enjoyment of the premises."

Many landlords prefer to stay away from any disputes between tenants.

Some cities have local "Noise Ordinances" which set stand ards for the level of noise and times of day during which noise must be regulated. You need to consult with the ordinances for the municipality in which you live to find out what regulations on noise may exist.

If after sending a letter to the tenant and speaking with the landlord, you are still unable to resolve this matter, you may still have recourse through the city. Most noise ordinances are drafted as a criminal law. You may be able to file a com plaint with the City's Prosecutor's office.

    Jaretwoman! I didn't realize you were in Ohio (I live in Columbus) Try this link for advice. This website is hosted by an attorney in Ohio, he answers the posts promptly and offers great free advice. I've turned to him on more than one occasion.
