ooh.. this is tough since you have mostly the back of the hawk and the lighting is dark. My first thought was an immature red-shoulder. Hopefully the experts will be along soon to help you out.

It is hard to get his front as he always has his back to us as he hunts in the next door field.He is also across our pond so by the time we get closer he is on the ground with his prey in deep weeds or he flies away.

If it's *larger* than most of the hawks you see around, then it's probably a Red-tailed Hawk. This bird has a lot of white on the underside to be a Red-shouldered (and in the second photo you can sort of see the beginning of a possible dark band across the underside - another Red-tailed characteristic). The juvenals won't have a red tail, which can make ID difficult.
