JM half dead after transplanting

I transplanted a Japanese Maple in fall 2006. Unfortunately the fellow who dug it up ignored my instructions and cut the roots 1 foot from the center. Last year, only half the tree leafed out but I hoped it would revive. Also it seemed like there were fewer leaves. However, this year, only half the tree leafed out again. What can/should I do? I have not pruned the tree at all. SHould I cut off the dead branches? It is about 7 feet tall. The tree is in a lawn (over the septic lines). It gets alot of water in the winter as the area is lower than the surrounding properties. Thanks so much for your help. Also it does not get hot here, but it does get windy.
