stupid staking questions

Better to not stake trees (at least not after the first year) so they build a strong trunk... ok, but what about trees that put out a lot of floppy growth in a season, so the top leans at an extreme angle? Still better to leave it if it's flopping over like an upside-down "U" or "J"? (For example, I have an Acer tegmentosum 'Joe Witt' that's like and upside down "J" at the top... it's in it's 3rd year and I didn't stake it previously, but I'm concerned the trunk will be leaning and awkward if I don't stake it when it's still young/pliable enough, at this point, as it has grown rapidly/nearly tripled it's size in 3 years.)

And what about staking to a leader or for shape, otherwise? Would it be better to use a small stake that isn't in the ground, but attached further down on the trunk?

Oh, and btw that same 'Joe Witt' has two lower branches that jut out almost horizontally... better to prune them off, leave as is, or tie to the trunk so they start to go more upright???
