Business deal gone bad?

I need some feedback: local i-net (buy & sell) site had adveritzed a mid 90's Yardman 42" 18hp tractor ad said

that the motor turns over (starter locked up.) $100.00. I

called and The fellow and i got to talking and he said

that he keeps blowing up motors in his JD model 68., i

said that i had a 8hp laying around that ran well- long

story short he said we can trade. I have stuck over $200

into the yardman to get it lawn ready and then put it on

line for $500.00, He E-mails me and calls me a A--hole and

that i will get mine apparently the motor i swapped him had

a broken exhaust stud and that made him mad, i honestly

did'nt know that was broke. anyhow he kept up with the name

calling so i sent him a check for $100.00 i'm not holding

my breath for a apology but what do you guys/gals think?

I don't think you should have paid him $100.00 for a broken exhaust stud. That defect could be fixed for way less than that amount. Did you guys have the option of inspecting the goods you intended to barter before each party agreed on the swap? If so, you shouldn't pay him anything, it was his responsibility to detect any obvious defects (and since an exhaust stud isn't hidden inside the engine, I would call that "obvious") Other than that, how much you have to spend on the MTD and how much you want to sell it for have no bearing on the situation.

I received my bulbs a week ago today, and they are excellent, they have the eyes already blooming from the bulbs. I also ordered plants, and they arrived the next day in a seperate order, since I was not expecting that order, and did not get the package until Sunday, I was worried, but planted them Sunday. I personally haven't had to deal with this sort of situation, but I have heard that "redistribution" of bonsai is generally best through the person's club or through close bonsai friends/aquaintances. Family may or may not be the best method (as you mentioned, as members may not be particularly interested/skilled/devoted). Another way is to a local (public) bonsai collection, perhaps at a conservatory or arboretum. - Audric

Yes that is a typo. The face plate of the brain was marked 2002 with a black marker but the metal plate holding it in place was [heat] stamped 2007. Sorry about the typo. I read about implied warranties, Thx. Here is what it says on the bottom of my bill of sale: "WARRANTIES SELLER DISCLAIMS. There are no implied warranties or merchantability, of fitness for a particular purpose, or any other warranties implied by the seller, covering the products sold pursuant to the Sales Agreement." Nothing is marked AS IS either. But I guess these legal words above mean 'as is.' It seems that ordinary people buy these spas, why would they put a mumbo jumbo legal term in there. Both of us have extensive business educations but neither of us have ever had these terms in any of our under grad or graduate Business Law classes. Hmm. Seems odd to me. Well we dont want scrap we want the brand new model, if this is what it means to buy a used spa. I dont want somebody else's trash, I really thought I stumbled on a good deal, especially when they upgraded the warranty to 5 yrs. It's a Calspa by the way.

Sorry but the date inside the unit on the front panel of the brain said 2002, it was written with a magic marker. Then the one on the top of the panel of the brain said 2007, that one was stamped into the metal. We only noticed that when the repair man came out the first time. We trusted the sales person that it was a 2 yr old model. In terms of the bill of sale, it says they give a 3 month grace period before they start charging for service calls. We have decided to upgrade and pay more money to them for a brand new unit. Kelly-Craigs List sells scrap. If it's free, it aint worth it. Yes I do have the opportunity to tell them to keep fixing it but if they cant fix the leaks after their 3rd visit, I'm not sure i want the spa. The new unit the offer is 800$ less than we can find it at the other spa stores so they are stepping up the plate to rectify the situation. We compared to quotes to see if they are really trying to work with us and it seems they are. We realize we bought 'as is' no matter what the savvy salesperson told me to our face. It's too bad becuase the unit is gorgeous--it looks brand new but when you see the dates inside the skirt, then you want to scratch your head.

I've been sober for 17 years and attend AA alot i guess i
just care nowadays but i feel confused about the whole deal
i decided to keep the Yardman tractor even though i have 4
other John Deeres parked in my shop garage under our deck.

The first trade 8hp engine for a Yardman tractor.
And the second trade was a $100 for maybe a apology.

I would have stopped at the first trade - theres no guarentees with used items and always something to repair.

And my apologies for referring to your Yardman as an "MTD". ( I have so much *hit on my desk with all kinds of notes and names, I guess I looked at something with MTD written down and lapsed into a coma. I apologize and a check for $100.00 is in the mail.

Don't let one A--hole put you off of doing what you want to do. I own an auto repair shop and I've had to deal with people like that over the years. I would not have give him the $100 and told him to go fly a kite! Dealing with the public is not easy sometimes.

I agree with passthegravy. For those of us who believe in an after life - you'll make it before the other guy. It's a shame you didn't get a chance to fix the problem but you'll be sleeping at night for trying to make it right.

You just gave him the $100 he was asking for the tractor, so he doesn't own the 8 horse anymore. Tell him you will give him $10 for fixing the stud, and you want it back!
