No expert here, but that looks like a Mimosa (Albizia julibrissin) to me. This link might help you find out for sure.

No, definitely not a fern. It is a tree. It could be one of many trees and I can't see enough detail to say. Some trees with similar leaves are Jacaranda, Acacia, Mimosa.....and the list goes on.

Close up of leaf would help if you could do that.

Rust is quite unusual on ferns. More than likely what you are looking at is reproductive spore. google fern spore pictures and look at the varieties.

I agree, looks like Mimosa (Albizia julibrissin) - a non-native tree that is very invasive in southeastern states and is showing up more and more on coastal areas of the northeast.

Not a fern, but a WEED.

If it is a mimosa my wife will be so happy.

Ferns show various differences from a flowering tree like this. One way you can tell a fern is that the new leaves start out as a fiddlehead, with a coiled tip.

So far I think it's a mimosa but it hasn't bloomed. I understand that's expected since the tree popped up only last summer.

So now the bottom branches are falling off. Is that normal for this time of year? If so, does anyone know how far up the branches will off? If they all do then it's going to look very odd in the winter. Simply a "Y" of a tree.

So far about half have fallen off.

The leaf is actually a compound type.
They're not branches per se. The Y
represents the true branch form.

The mimosa leaves have a more grayish tone to them, I think. It is a member of the legume family, Fabaceae but this is a very extensive family.
Check out Calliandra haematocephala and Calliandra suriinamemsis.
Here is Costa Rica trees showing leaves like this are all over the places, with just a slight difference in size, including Delonix regia

No member of the Genus Calliandra is hardy in New York state. This tree has been through at least one Winter.

Yes, I missed that. Another 'guess' is the same tree that grows outside of many Costco warehouses....
We have a similar one here called Cojoba costaricensis, Lorito or Angels hair.
