Unable to identify a plant growing in my herb garden.

I started my first herb garden this past spring and have had a hell of a time getting it started. I've had not previous experience at maintaining a garden at all. It probably took a month to get some decent sized seedlings. Then I moved some of the sprouted basil, chives, oregeno, parsely and sage to bigger containers. Then a storm hit; the starter containers were blown off their ledge and onto my porch. I persevered and bought a long planter, added some soil and moved all the dirt off the porch and into the new planter. I am happy to report that I have identified Terragon is growing, thyme, more chives and basil. Also some arugula, which i did not plant ,however it grows wildly in my yard. Also this other creature sprouted up. It is over a foot tall now and I am worried that it might be a tree. :D

Could you help me identify it? {{gwi:318850}} {{gwi:318851}}

Off-topic: Just to update my progress. The parsley and sage never grew after moving into the new containers and the oregeno was severely stunted; it has since rebounded nicely.
