Hydrangea 'NCHA1', also known as Invincibelle Spirit (note spelling), and some of the Cityline series of hydrangeas (actually at least six different cultivars are part of this series) are patented, therefore propagation by cuttings (for any reason whatsoever) would be illegal without the permission of the patent holder. You might want to stick with commercially produced (legal) plants for these cultivars.
Some people buy plants that do not always end up working in their garden so I would not advise the original poster to stick with non patented plants. It is perfectly fine to trade a patented plant that you purchased that does not work in your garden for a plant that will.
You may have misread my post. It pertained to cuttings, NOT to "plant that (someone) purchased" OR "advis(ing) the original poster to stick with non patented plants."
Profit has nothing to do with whether it's illegal to propagate patented plants. It's even every bit as illegal to propagate a patented plant for your own personal use and from a plant you already own, as it is to propagate one for commercial sale. The law makes it clear that your purpose or intent is irrelevant. If you want to legally obtain one of the cultivars mentioned, you need to either buy commercially produced plants (whether or not they are "preowned", as Denise seemed to be talking about) OR get permission form the patent holder to propagate your own plants.
