Why are you changing the privacy policy and terms of service?

We recognize that privacy is an important issue for users, and we are committed to ensuring our users. privacy. We have updated the policies to clarify what and how the information you provide is shared and to improve the user experience.

How does this change affect the way GardenWeb uses my personal information?

Personal information collected prior to the Effective Date of the new policies shall be governed by the policies in effect at the time your personal information was collected.

How will my personal information be used going forward?

Any personal information you provide to GardenWeb from the Effective Date of the new policies forward is governed by the updated Privacy Policy and Terms of Service. Please see How We Use (and Do Not Use) the Information We Gather in the updated Privacy Policy.

1. What policies govern my use of the GardenWeb Network after January 24, 2006?

On January 24, 2006 a new Privacy Policy and Terms of Service go into effect and will govern the use of any personally identifiable information ("PII") and user provided content, including, but not limited to, posts, text and photographs ("User Provided Content") provided to the Garden Web Network on and after January 24, 2006.

2. If I do not agree with the new Terms of Service and/or the new Privacy Policy, what are my options?

If you do not agree with the GardenWeb Privacy Policy and Terms of Service, effective January 24, 2006, you should cease all uses of the GardenWeb Network of websites prior to January 24, 2006. Continued use and access of the GardenWeb Network, together with any PII or User Provided Content provided to or collected by GardenWeb on or after January 24, 2006 will be governed by the policies then in effect. Please take note that informing GardenWeb that you do not agree to the January 24, 2006 Privacy Policy and Terms of Service, while continuing to use, access and/or provide the GardenWeb Network with PII and User Provided Content on or after January 24, 2006, does not void your acceptance of these new policies.

3. What policies govern PII and User Provided Content provided to the GardenWeb Network prior to January 24, 2006?

The GardenWeb policies in effect at the time you provided PII and/or User Provided Content shall continue to govern GardenWeb.s use of such material after January 24, 2006. By way of example, if you posted a picture of a Rose on the Roses Forum prior to January 24, 2006, the terms of the policy in effect at the time you posted the picture shall govern GardenWeb.s use of the photograph.

4. Does GardenWeb have any rights in the User Provided Content posted to the GardenWeb Network after January 24, 2006?

By submitting, posting or otherwise providing User Provided Content to the GardenWeb Network on or after January 24, 2006, you grant the GardenWeb Network a continuous right to use this material. Please see Section 7 of the January 24, 2006 Terms of Service. Neither ownership or copyright to the User Provided Content is granted to the GardenWeb Network under these new policies.

5. Does GardenWeb have any rights in my own website that I use outside of the GardenWeb Network?

The Terms of Service, with an effective date of January 24, 2006, includes references to your "personal website." This reference does not govern any personal URL or online environment you may have created outside of the "public areas" of the GardenWeb Network. Section 7 of the January 24, 2006 Terms of Service governs public areas and personal websites which may reside within the GardenWeb Network. Please refer to Section 1 (Acceptance of Terms of Service) , for the definition of the GardenWeb Network.

Your "personal website" within the GardenWeb Network could include your profile and any other area you customize on the GardenWeb Network.

"Public areas" can include the Forums, Exchanges and any other area on the GardenWeb Network in which users engage in open discussions.
